ORDERS OF PROTECTION

NOTE: ORDERS OF PROTECTION MAY BE ISSUED BY ANY COURT IN THE STATE OF ARIZONA
 

Orders of Protection may be obtained at the Court on Wednesdays. We strongly suggest that you contact the court at (928) 649-7730 prior to appearing. The Judge may be in court or unavailable, and you may have to wait a substantial amount of time before being seen.

Orders of Protection are issued only based on the following relations:

  • Against your current or former spouse
  • Someone of the opposite sex with whom you live with or lived with
  • One party pregnant by the other party or someone you have a child in common with
  • One of your relatives or spouse’s relatives

An alleged crime of domestic violence must have been committed by one of the relations listed above to obtain the order. Domestic violence includes assault of any kind (child or vulnerable adult abuse, criminal damage or trespassing, any crime against a child, custodial interference, disorderly conduct, endangerment, kidnapping, threats or intimidation or unlawful imprisonment).

The Court must know if there are any other court orders or court proceedings regarding the defendant in the order. IF THERE IS A DIVORCE PENDING, ORDERS MUST BE OBTAINED THROUGH THE SUPERIOR COURT IN WHICH THE DIVORCE IS PENDING.

Upon your prepared petition, an ex-parte hearing before the Judge will be held and  the Judge will either grant or deny the Order of Protection.. There is no fee for the order or for its service upon the defendant.
